Delivery:

1. Risk in products shall pass to The Buyer on delivery
2. Delivery dates are given in good faith but are estimate only.
3. Time for delivery shall not be of essence of the contract.
4. The Company reserves the right to cancel any outstanding back order for any discontinued product lines without liability.
5. Neither the Company, nor any of its directors, officers, employee or agents, shall be liable for any Loss arising from any action taken, or omitted, by it or them, under or in connection with the    Agreement or the assignment.
6. Without prejudice to clause 5(d) the company shall not in any case be liable for indirect or Consequential damages.
7. The Company’s total liability under or in connection with the agreement (except in the case of Willful misconduct) whether founded in contract or in tort, is limited in respect of any events or Series of connected events, to a sum equal to the total contract price payable for the duration of the Agreement or for six month (whichever is shorter).
8. Carriage charges are applied at the current rates supplied by the company’s appointed courier.Saturday deliveries will be subject to the surcharge applied by The Company’s courier. These rates are subject to change without notice.
9. Any goods delivered as “sample” will be treated as a normal sale at the current pricing rate and are Subject to carriage charges and value added tax which will be added.
10. Nothing in this agreement shall exclude The Company’s liability for death or personal injuries      Caused by the company’s negligence.  

Claims:

The Company accepts no liability for loss or damage to goods in transit unless.

Returns:

1. Goods returned by The Buyer without the consent of the company will not be accepted for credit or replacement and are subject to the companies official returns policy.
2. The Company reserves the right to refuse to credit the value of any returned Goods, which are not in a saleable condition.
3. No used goods will be accepted as a returned item after 6 months from the date of invoice. I think this should be “No used goods will be accepted as a returned item after 3 month from the date of Delivery.
4. Any returns within 3 month of the date of invoice may only be subject to a maximum credit note of 50% of the original product value dependent upon usage.
5. No returns will be accepted for discounted products or products marked as “second”. Or discontinued products.
6. The Company will be entitled to make an additional charge if, in its discretion, it agrees to accept the return of goods at the Buyer’s request.
7.  Carriage charges will be applicable for any returns received which have not been issued with a Returns number.
8. Non acceptable returns are subject to carriage charges at the Company’s discretion.

Exchange of Goods

Goods once sold will not be accepted for exchange ....................................

Or we do accept exchange we must write

1. Only unused goods returned in original condition shall be accepted for exchange. The company Reserves the right to reject any goods that are found not to be in saleable condition
2. Goods must be exchange within 20 days from the date of sale.
3. Discounted / Discontinued products shall not be accepted for exchange after sale.
